OPINION AND ORDER

LAFFITTE, District Judge.

Before the Court are the motions for summary judgment of Defendants Emilio Diaz Colón (“Díaz Colón”) and Pedro Toledo (“Toledo”) in this action for damages under section 1983. 1 Toledo is the superintendent of the Puerto Rico Police Department; Diaz Colón is the chief of the Puerto Rico National Guard (“PRNG”).
