Defendant in error brought this action in the court below- to recover on an insurance policy issued by plaintiff in error to one Sol. J. Homer, which, after destruction of the property insured, was assigned by Homer to defendant in error. Several questions of law are presented by plaintiff in error’s assignments, but the only questions that we need consider and determine are, first, the effect of certain conditions and stipulations in the policy; and, second, whether such conditions and stipulations were waived by the plaintiff in error.
