This was an issue tried upon the settlement of an insolvent estate, between the administrator and the defendant in error. The record discloses, that after several trials .between these parties, on the 2d October, 1844, a verdict was returned for the administrator, and judgment rendered accordingly, and afterwards, on the 30th October, 1844, a motion was submitted by the plaintiff to the court for a new trial.
