The plaintiff, an Illinois corporation, filed this bill to stay proceedings at law and to cancel a life insurance policy, alleging fraud, misrepresentation, and false statements in the application for the insurance. The policy was issued by plaintiff on the life of Blazej Palen, payable to Rozalia Palen, his wife. The insured and the beneficiary are both deceased and the beneficiary’s estate (defendant herein) now continues the case by Sophie Palen, administratrix thereof.
