The defendant was informed against for murder in the second degree and, being convicted thereof, has appealed. The grounds of appeal are of such nature as to make it necessary that we state in a general way what the evidence in behalf of the State shows.

The defendant and the man he is accused of killing are both Cocopah Indians and lived on an Indian reservation west of Somerton in the Yuma Valley, Yuma county, Arizona.
