On June 21, 2000, Defendant Winston Alen was indicted for conspiracy to distribute marijuana (Count I) and for attempted possession of marijuana with intent to distribute (Count III). Prior to trial, the district court established a plea-bargain cut-off date of Wednesday. August 23, 2000. Initially, defendant expressed his intent to accept the plea bargain, but he changed his mind, and the case was set for trial on Monday, August 28, 2000.
