Appeal from the District Court of Clay. Tried below before the Hon. B. F. Williams. The indictment in this case charged the appellant with the murder of the infant- Steagald, in Clay county, Texas, on the twentieth day of January, 1886. The effort of the State was to establish against the appellant a murder scarcely paralleled in atrocity by any recorded in the annals of crime, and unexcelled in deliberate diabolism by any yet conceived as fiction.

A motion is made by the Assistant Attorney General to dismiss the appeal in this case, because “ there is no such final judgment in the record as will support an appeal.”
Appellant was found guilty of murder of the first degree, his punishment being assessed at death. As set forth in the record, *485the judgment rendered by the court is in the following words, viz:
