Appellant was convicted of the murder of one Tullos, in the district court of Wilson county, and his punishment fixed at confinement in the penitentiary for life. The case originated in Atas-cosa county, and was sent to Wilson county upon change of venue. It is urged that the trial court should have discharged Juror Darelik of the court’s own motion, and that his failure to do so was error.
