On 1 May 1989 defendant was indicted on counts of malicious assault in a secret manner with a deadly weapon with intent to kill, assault with a deadly weapon, conspiracy to commit the offense of assault with a deadly weapon with intent to kill inflicting serious injury, and two counts of assault with a deadly weapon with intent to kill inflicting serious injury. On 2 October 1989, without prejudice to the State, Judge Britt granted defendant’s motion to dismiss the charges for denial of a speedy trial under the Speedy Trial Act, former N.C.G.S. § 15A-701 et seq.
