HERLANDS, District Judge.
The Court will dictate its opinion and decision consisting largely of findings of fact and conclusions of law.
Findings of Fact:
1. The action brought by plaintiff is founded upon two causes of action;(a) A declaratory judgment to hold the patent in suit not infringed and invalid, and “by the patent in suit” the Court refers to the patent issued to Valentine et al., No. 2,337,695, to a “Powder Puff and Method of Making the Same.”
