This suit was brought by the appellee against the appellant for damages for the conversion of certain steers, the property of the appellee. It appears from the evidence that one Sims gave a mortgage to the appellee upon the property described in the complaint, that the defendant is a partnership composed of J. R. Kilgore, frequently referred to in the testimony as “Bob” Kilgore, and John Kilgore; and that Bob Kilgore was the father of John Kilgore.
