This case concerns the U.S. Department of Energy’s (“DOE”) obligation under the National Environmental Policy Act of 1969 (“NEPA”), 42 U.S.C. § 4321 et seq., to publish an environmental impact statement (“EIS”) prior to taking any action that may. significantly affect the quality of the environment.
