This case involves an appeal pursuant to section 41 of the Environmental Protection Act (Ill. Rev. Stat. 1979, ch. llBz, par. 1041) from an order of the Illinois Pollution Control Board (Board) entered on July 3, 1980. Section 41 of the Act provides, in pertinent part, that “any person who has been denied a variance ” ° may obtain judicial review directly in the Appellate Court for the District in which the cause of action arose and not in the Circuit Court” (Ill.
