MEMORANDUM OF DECISION AND ORDER

The plaintiffs, Edward A. Peruta (“Peru-ta”) and Harris Agricultural Enterprises, Inc. (“HAE”) (collectively, “the Plaintiffs”) bring this action for damages arising out of an arrest following an alleged motor vehicle theft. It is brought pursuant to the Fourth and Fourteenth Amendments, 42 U.S.C. § 1983, and the common law tenets of malicious prosecution and intentional infliction of emotional distress.
