NATURE OF CASE
Rodolfo C. Falcon was charged with driving under the influence of alcohol or drugs, in violation of Neb. Rev. Stat. § 60-6,196 (Reissue 1998). Trial was held to the county court on stipulated facts. The county court found Falcon not guilty. The State filed a notice of intent to appeal with the district court, pursuant to Neb. Rev. Stat. § 29-2317 (Reissue 1995).
