This cause is here on leave to appeal granted to review a judgment of the Appellate Court for the Third District affirming a judgment entered in the circuit court of Greene county in favor of appellee in the sum of $3500, on appeal from the county court of that county.

Appellee, Frank Dawdy, administrator of the estate of Anna Strickland, who died on March 20, 1939, filed a petition in the county court of Greene county for the issuance of a citation against appellant, son of the deceased, under sections 81 and 82 of the Administration act.
