This action is based upon the same facts narrated in First Nat. Bank v. Gibson, 57 Neb. 246, and 60 Neb. 767, *233with the additional fact that, after the former adjudication that the plaintiff’s judgment was a lien upon the land in controversy, the premises were sold upon a prior lien by a decree of the United States circuit court for the district of Nebraska, so that the plaintiff had no benefit from its judgment or decree.
