Haft, J.), entered May 17, 1985, granting defendant’s motion to dismiss an indictment, which had charged him with two counts of robbery in the first degree and one count of robbery in the second degree, unanimously reversed, on the law, the indictment reinstated and the matter remanded to the Supreme Court for further proceedings.
