Order, Supreme Court, Bronx County (Archie Gorfinkel, J.), entered November 13, 1985, which granted defendant’s motion to dismiss the indictment pursuant to CPL 210.30, unanimously reversed, on the law, and the indictment reinstated.

Defendant was indicted for the crimes of attempted rape in the first degree and assault in the second and third degrees.
