Kapper, J.:

On November 29, 1921, at about one o’clock in the afternoon, a theatre building that was being erected on Bedford avenue in the borough of Brooklyn collapsed. Amongst other casualties, the plaintiff’s intestate, who was a workman in the employ of a metal ceiling company and engaged on ceiling work, was killed. The defendants concede his death to have been caused by the collapse of the building. The building was called the American Theatre.
