The Lipan and Mescalero Apache tribes invoke the Indian Claims Commission Act, 25 TJ.S.C. § 70a (1964), for compensation for the loss of their ancestral lands within the State of Texas. They seek to hold the United States responsible for the actions of its officers, agents, and troops who in 1858 and 1859 — appellants allege — joined with Texas forces to drive the Indians from their lands.
