MEMORANDUM OPINION AND ORDER

KRAM, District Judge.

The above-captioned action is before this Court upon defendant’s motion for dismissal or summary judgment in its favor. For the reasons stated below, defendant’s motion for summary judgment is granted.

BACKGROUND

On May 27, 1978, plaintiff First Friends Jewelry Corporation (“Friends”) purchased an insurance policy under the Federal Crime Insurance Program (“FCIP”).
