INTRODUCTION

This is a contribution action brought under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”) 42 U.S.C. § 9601 et seq. and its Pennsylvania law counterpart, the Hazardous Sites Cleanup Act (“HSCA”), 35 Pa. Stat. Ann. § 6020.101 et seq. The litigation arises from the contamination of the Malvern TCE Superfund Site in Malvern, Pennsylvania (the “Site”).
