LIGHTFOOT, Chief Justice.
W. H. Hunt was a merchant in Queen City, Cass County, Texas, on the 16th day of December, 1889, and for several years prior thereto. On the above date he executed and delivered a deed of trust or chattel mortgage, by which he conveyed to W. H. D. Hunt, as trustee, his entire stock of merchandise, and put him in the actual possession of the same, and directed him to sell the same and apply the proceeds to the payment of three certain preferred debts, claimed to be owing by him to said W.
