The plaintiff, Sam Davis, brought action in quantum meruit for wages alleged to be due him from the defendant, Sullivan Gold Mining Company, and, on demand, furnished a bill of particulars in which he claimed to have worked from March 20, 1932, to March 20, 1933, during which time his services were of the reasonable value of $90 per month; 5 days in December, 1933, 28 days in January, 1934, and 5 days in December, 1934, for which 38 days his services were of the reasonable value of $3 per day.
