ROSE, District Judge.

The plaintiff sues the defendant for an alleged breach of a contract by which the plaintiff became general agent for the defendant. The plaintiff will be called the “agent,” the defendant the “company.”

The declaration sets forth the agreement in full. By it the agent became general agent of the company for the states of Maryland and Pennsylvania. In that territory he was to appoint all agents or sub-agents. His compensation was to he 32l/> per cent, on all premiums, less return premiums and reinsurances collected for all business written within the territory for account…
