Appeal from Jones Circuit Court. Action to recover for personal injuries sustained by plaintiff by a fall from a bridge upon a street of the town, while riding over it in a sleigh; the accident occurring through the fault of defendant in failing to erect and maintain railings or barriers to the bridge. There was a judgment upon a verdict for plaintiff. Defendant appeals.

The plaintiff moves to affirm the judgment of the circuit court on the ground that defendant failed to file the abstract and arguments in the case within the time prescribed by the rules of the court.
