Defendant filed a petition for post-conviction relief in which he asserted multiple claims of ineffective assistance of trial and appellate counsel. The trial court denied the petition. On appeal, the Appellate Division reversed, concluding that trial counsel was ineffective for failing to fully elicit alibi evidence and for failing to object to a comment in the prosecutor’s opening statement, and that appellate counsel was ineffective for not raising those issues on appeal as well as the issue of the trial court’s refusal to give an…
