This was an action in ejectment, filed in the superior court of Tulsa county by E. S. Warner, plaintiff in error,, as plaintiff, against Margaret C. Wiek-izer and others, defendants in error, as defendants, for the recovery of 160 acres of land, rents and profits.

The land was allotted to the heirs of Tecumseh Tiger, deceased Creek Indian citizen. It was admitted by the parties that Albert Tiger was the sole heir of Tecumseh Tiger, deceased, and was. assumed by the parties that, at the time of the conveyance by Albert Tiger, hereinafter mentioned, the latter was not…
