In a prosecution by the state in the district court for York county, Nebraska, Samuel 0. Nelson, defendant, was convicted of embezzling $1,900 belonging to his principal, the York Alfalfa Milling Company, and for that felony was sentenced to serve a term of five years in the penitentiary. As plaintiff in error he now presents for review the record of his conviction.
