Plaintiffs-homeowners bring suit against Defendant-mortgage loan servicer for their alleged failure to properly review and investigate errors made in the evaluation of Plaintiffs’ application for a modification of their home loan. As a result of Defendant’s denial of the loan modification application, a judgement of foreclosure was entered against Plaintiffs in a separate state court proceeding.
