BATES, District Judge.

This is an original proceeding in which the plaintiffs are seeking to restrain and enjoin the defendant district court from authorizing the defendant Hanson, as special adminis trator, to pay to one Kathryne C. Kidman money out of the estate of John Phillip Byrne to be used by her for her support and maintenance and as suit money and for counsel fees to assist her in establishing that she is the surviving widow of the deceased, and as such entitled to participate in the distribution of his estate.
