—Appeal by the defendant from a judgment of the County Court, Nassau County (Orenstein, J.), rendered June 21, 1991, convicting him of murder in the second degree (felony murder), robbery in the first degree, and grand larceny in the third degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, after a hearing, of those branches of the defendant’s omnibus motion which were to suppress evidence, his statements to law enforcement authorities, and eyewitness identification.

Ordered that the judgment is modified, on the law, by deleting the provision thereof…
