Staff members at a nursing home became concerned that a visiting family member had mistreated an elderly resident of the home and contacted the police. The visitor was arrested and charged with simple misdemeanor assault, but a jury acquitted her. After she was acquitted of the criminal charge, the visitor brought this civil action asserting negligence, false imprisonment, and malicious prosecution theories against the arresting officer and the city that employed him.
