This was an action on the case, brought by appellant against appellee, to recover damages for the destruction of property by a riotous mob, in the city of Spring Valley on the night of July 6, 1894. The right to bring the suit is founded upon an act of the legislature passed in 1887, and in force July 1, 1887, entitled “ An act to indemnify the owners of property for damages occasioned by mobs and riots.” 3.
