This matter is before this court upon appeal from an order of the Court of Common Pleas of Franklin county.

The action relates to a proceeding whereby the defendant is cited to appear and show cause why he should not be punished for contempt for failure to pay alimony. The original petition in divorce was filed in the Court of Common Pleas of Franklin county by Olive B. Sherwood, plaintiff, residing in Franklin county, against her husband, Robert C.
