Introduction
Before the Court are two separate Motions to Dismiss the Plaintiffs’ Amended Complaint. The first motion is filed by 4th Walnut Associates, L.P., Ivy Realty LII, LLC and Ivy Realty Services, LLC (herein sometimes collectively referred to as “4th Walnut”). The second motion is filed by Sovereign Bank (“Bank”). Each mov-ant seeks dismissal of the specific counts directed against them.
