Dent, Judge:
P. M. Teel, administrator of George Teel, deceased, obtained *86a writ of error to this Court from the judgment of the circuit court of Cabell County sustaining a demurrer to the evidence in a certain case therein pending wherein he was plaintiff and the Ohio River Railroad Company was defendant.
