SHERAN, Chief Justice.

Defendant was found guilty by a district court jury of a charge of theft over $2,500, Minn.Stat. § 609.52, subds. 2(1) and 3(1) (1980), and was sentenced by the trial court to a 10-year prison term with execution stayed and defendant placed on probation for 5 years conditioned upon defendant’s spending the first year in the workhouse and making restitution.
