This appeal results from the defendant’s second trial on charges arising from a robbery. Originally, a jury convicted the defendant of two counts of assault with intent to murder, MCL 750.83; MSA 28.278, one count of breaking and entering with intent to commit a felony, MCL 750.110; MSA 28.305, and two counts of assault with intent to rob while unarmed, MCL 750.88; MSA 28.283.
