Defendant Williams was charged by information in Count I with bookmaking, in Count II with unlawfully keeping a place for recording bets, and in Count III with having recorded or registered bets (Pen. Code, § 337a, subds. 1, 2 and 4). His codefendant Smith was charged in Count I with bookmaking and in Count IV with permitting rooms to be used for bookmaking or for receiving and recording bets (Pen. Code, § 337a, subd. 5).
