On November 13,1904, P. C. Massie, Jr., a resident of the State of Alabama, died there testate, leaving to survive him a widow, Bessie K. Massie, and two children, Joel W. and Jane. At the time of his death he was the owner of two tracts of orchard land in Nelson county, Virginia; one of them known as Poverty Point contained 181 acres, the other as Pharsalia, contained 48 146/160 acres. This testator devised his whole estate to his widow, who did not undertake to manage this property herself, but through a brother-in-law, Withers Massie. He rented Poverty Point orchard to H. B.
