On January 26, 2000, A C Air Conditioning and Heating, Inc. ("A C"), sued its employee, Jimmy Cleckler, pursuant to § 25-5-88, Ala. Code 1975, in the Circuit Court of Shelby County, seeking a determination as to whether the injuries alleged to have been sustained by Cleckler during the course of his employment with A C were compensable.
