HAWTHORNE, Justice.
About two o’clock in the afternoon of January 27, 1947, the accused, who was proceeding east on U. S. Highway 90 in a Plymouth automobile, picked up Charles McSorley, a hitchhiker, somewhere in the vicinity of the Higgins Industries plant, a few miles east of New Orleans. McSorley’s destination was Miami, Florida, and the defendant Davis’s avowed destination was Jacksonville, Florida.
