The defendant, Walter Bentley, is appealing from his conviction and sentence to death on an indictment charging him with the crime of aggravated rape, contending that the trial judge erred (1) in overruling his motion for the appointment of a lunacy commission to determine his mental condition at the time of the trial and also at the time he allegedly committed the crime, and (2) in failing to enter a mistrial when the prosecuting attorney in his opening argument to the jury remarked “that evidence is uncontradicted and uncontroverted,” which was tantamount to a comment…
