As a result of a motor vehicle accident on September 17, 1982, the defendant was indicted for vehicular homicide (G. L. c. 90, § 24G[¿z]), operating a motor vehicle negligently so that the lives and safety of the public might be endangered (G. L. c. 90, § 24[2][o]), and operating a motor vehicle while under the influence of intoxicating liquor (G. L. c. 90, § 24[1]).,Following a jury trial on all of the indictments, the defendant was convicted only on the indictment that charged him with operating a motor vehicle while under the influence of intoxicating liquor.
