The plaintiff has brought an action against the defendants to recover damages for breach of contract involving the purchase and sale of a parcel of land, on the north side of Route 17 in the town of Vestal, Broome County, New York. The case was tried before the court without a jury.

On the 18th day of March, 1950, the defendants, who owned a vacant parcel of land, which measures approximately 150 feet front and rear and 90 feet deep, gave the plaintiff a written option to purchase the property for $6,500.
