Motion by the People for reargument of an appeal from a judgment of the Supreme Court, Suffolk County (McInerney, J.), rendered January 16, 1985, convicting him of attempted criminal possession of stolen property in the first degree, upon a jury verdict, and imposing sentence, which was decided by decision and order of this court, dated December 31, 1986 (see, People v Aharonowicz, 125 AD2d 682).

Ordered that the motion is granted and, upon reargument, this court’s decision and order dated December 31, 1986, is recalled and vacated, and the following decision and order is substituted therefor:
