Appeal from an order of the Appellate Division of the Supreme Court in the third judicial department^ entered March 12, 1907, which reversed a judgment of the Ulster County Court rendered upon a verdict convicting the defendant of the crime of manslaughter in the first degree, and granted a new trial. The facts, so far as material, are stated in the opinion.

The defendant was indicted for the crime of murder in the second degree and convicted of manslaughter in the first degree. The crime was charged to have been committed on the 4th day of December, 1905, at the town of Woodstock, in the county of Ulster. The victim of the alleged homicide was Oscar Harrison, a white person about twenty years of age at the time of his death. The defendant is a negro who at that time was about fifty-five years old. Harrison was found dead in the dwelling of the defendant near Woodstock on the morning of December 5th, 1905, under circumstances which left no doubt…
