This is an appeal by defendant company from a judgment entered against it on a Case Stated. The facts are correctly set forth in the opinion of the lower court by Lewis, J., from which we quote as follows: “It appears by the facts agreed upon that plaintiff is engaged in business at No. 720 Market Street, Philadelphia, which place of business was covered by insurance under a policy of insurance issued by the defendant company, known as a 'Mercantile Burglary Policy’.
